All Night Long – Terms and Conditions

By registering for "All Night Long", a 42km overnight walking challenge ("the Event"), participants agree to abide by these Terms and Conditions.

The Event is organised by Ronald McDonald House Charities South East Queensland, Children’s Hospital Foundation and Atlas Events (collectively, "the Organiser").

1. Declaration

  1. Information on how to enter forms part of this these terms and conditions.
  2. By registering, you acknowledge and accept all terms and conditions.

2. Eligibility

  1. Participants must be over 18 years of age on the day of the Event.
  2. The Organiser reserves the right to verify the age and identity of participants.
  3. Participants must be medically and physically fit to participate and must not pose a danger to themselves or others.

3. Fees

  1. The individual entry fee is AUD $60.00 (plus transaction fees, including GST) payable through allnightlong.org.au
  2. The Organiser may offer discounted entry fees at its discretion.
  3. Registration is confirmed upon payment and written confirmation from the Organiser.
  4. Spectators may attend free of charge.
  5. Registration fees are non-transferable. 
  6. Registration fees will not be refunded to you if you change your mind about participating and cancel your registration, the Event is cancelled because of an event beyond human control (like a natural disaster) or because of a change in law or other government restriction that stops the Event from being held. 

4. Fundraising

  1. Participants are required to raise a minimum of AUD $500 in support of Ronald McDonald House Charities SEQ and Children’s Hospital Foundation. Donations are non-refundable. 

5. Health and Safety

  1. Participants acknowledge the physical demands of the Event and are responsible for ensuring they are medically fit.
  2. Participants should consult a medical professional prior to the Event.
  3. Participants must disclose any medical conditions that may affect their participation.
  4. Emergency contact details must be provided and may be used in the case of an emergency.
  5. Costs of medical treatment and ambulance transportation are the responsibility of the Participant.

6. Event Conduct

  1. Participants must check in on the day at a designated check-in area.
  2. Participants must follow the designated route and comply with instructions from Event staff and volunteers.
  3. Alcohol and recreational drugs are strictly prohibited during the Event.
  4. Local laws, community standards, and environmental considerations must be respected. The Participant must behave respectfully to other participants and not engage in conduct which is inappropriate, offensive, abusive or a risk to their own or someone else’s safety or property.
  5. The Event is a personal challenge, not a race.
  6. There are five pit stops along the course.
  7. If a participant chooses to abandon the Event, they must immediately notify the Organiser or a volunteer.
  8. The Organiser reserves the right to limit or withdraw participation at its discretion at any time, including during the Event and where the Organiser considers the Participant has failed to comply with these terms and conditions or the Participant’s conduct is considered, inappropriate, offensive or abusive or a risk to their own or someone else’s safety or property.

7. Parking and transport

  1. The Organiser does not provide parking. Participants and spectators are responsible for their own parking arrangements. 
  2. Participants are responsible for their own transport home, regardless of completion status.

8. Event Changes and Cancellation

  1. The Organiser reserves the right to modify the Event format, route, or schedule due to unforeseen circumstances such as weather or public health concerns.
  2. In the event of cancellation, the Organiser will notify participants and may offer alternative arrangements.

9. Liability and Insurance

  1. Participation involves physical risk including potential injury or death.
  2. Participation is at the participant’s own risk. The Participant accepts full responsibility for their health, training, insurance, and personal belongings.
  3. The Organiser is not liable for injury, loss, or damage to the Participant or their property except to the extent this cannot be excluded by law.
  4. Participants are encouraged to secure personal insurance coverage.
  5. To the maximum extent permitted by law, the Participant:
    1. releases and will release the Organiser from all claims that the Participant may have or may have had but for this clause arising from or in connection with the Participant’s participation in the Event; and
    2. indemnifies and will keep indemnified the Organiser in respect of any claim by any person against all associated parties in respect of any injury, loss or damage arising out of or in connection with the Participant’s failure to comply with the Organisers' rules and/or directions,

except that the above releases and indemnities shall not apply to the extent that the loss, damage or injury that is the subject of the claim is caused or contributed to by the negligent act or omission of the Organiser.

  1. To the extent that the Event involves the supply of ‘recreational services’ as defined by the Competition and Consumer Act 2010 (Cth), or equivalent state or territory legislation (as applicable), you agree that the Organiser is not liable, in respect of any consumer guarantee relating to the supply of the services under the Australian Consumer Law, for:
    1. death;
    2. physical or mental injury (including the aggravation, acceleration or recurrence of such an injury);
    3. the contraction, aggravation or acceleration of a disease;
    4. the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs:
    5. that is or may be harmful or disadvantageous to the Participant or the community; or 
    6. that may result in harm or disadvantage to the Participant or the community, 

arising from participation in this Event.

  1. The limitation in clause 6 above does not apply to significant personal injury suffered by the Participant that is caused by the reckless conduct of the Organiser. The Organiser’s conduct is reckless conduct if the Organiser:
    1. is aware, or should reasonably have been aware, of a significant risk that the conduct could result in personal injury to another person; and
    2. engages in the conduct despite the risk and without adequate justification.

10.  Photography and Media

  1. By participating, you consent to being photographed or filmed for promotional use without compensation. You consent to us and people we authorise using those photographs or films to promote the Event, or the Organiser, including in print, promotional material and online, including in social media, with or without attribution to you by name.
  2. If our platform allows you to upload content to your fundraising page for the Event, you are responsible for ensuring that you have all necessary permissions to include any copyright material, or any personal information, that you include in that content, and for ensuring that any content that you upload is not illegal, offensive, defamatory, obscene, threatening, discriminatory, fake or misleading, or which could give rise to civil or criminal proceedings. The Organiser may edit or remove inappropriate content from fundraising pages. 

11. Data Protection

  1. You must read the Privacy Statement for the Event, and the Organiser’s Privacy Policies referred to there. 
  2. If you provide personal information about any other individual to the Organiser, you must ensure they are aware of the Privacy Statement and Privacy Policies and agree to their personal information being provided.

12. Governing Law

  1. These Terms are governed by the laws of Queensland, Australia.
  2. Any disputes will be resolved in the courts of Queensland.

13. Definitions

  1. Agreement: These Terms and Conditions.

  3. Organiser: Ronald McDonald House Charities SEQ, Children’s Hospital Foundation, and Atlas Events.
  4. User/You: Anyone using or accessing the Site or participating in the Event.
